How medical malpractice may occur

However, there are many other types of medical malpractice that are more common.

A misdiagnosis or a lack of a diagnosis is one common type of medical malpractice. For this to rise to the level of malpractice, it must be demonstrated that the patient did not receive a reasonable standard of care from the doctor, meaning that misdiagnoses may happen that are not necessarily malpractice. Medication errors are another common mistake. According to the World Health Organization, more than 1 million people in the United States are harmed each year by medication mistakes. These are most common when a person has several health care providers or because of communication issues. Mistakes can happen at any point, including during ordering, preparing or prescribing. They may involve the wrong dosage or the wrong medication altogether.

Another type of error is an anesthesia error. Incorrect dosages could lead to such consequences as seizures, brain injury or death. Finally, birth injuries, in which a mother or a child is injured during labor, may be another form of medical malpractice if they are the result of negligence.

Injuries that may result from medical malpractice can have serious consequences. A person may take longer to heal from an illness or might develop additional conditions. In some cases, the injury could be permanently disabling. Compensation may help pay for expenses associated with the malpractice, including lost income. Patients who are injured by medical malpractice may want to consult an attorney. Some medical providers may offer an out-of-court settlement, but the patient is not obligated to accept it and may want to go to trial.
