Reasons Your Veterans Disability Claim Might Be Denied

Any small misstep can get your veterans disability claim denied. The process of applying for benefits can be frustrating and overwhelming, which is why we are here to help. There may be a variety of reasons for a denied claim — some common reasons include:

  • The VA says your disability did not happen while in service. In order to receive benefits, you have to prove to the VA that your disability occurred due to an incident that happened while you were in service. Without adequate documentation of such an in-service incident, or if the VA deems the incident did not cause your disability, your claim will likely be denied.
  • The VA does not believe your doctor. Even if your doctor supports your claim, the VA may reject their opinion. If your doctor failed to comment on the specifics of your disability claim or respond to the specifics in your file, the VA may deny your claim. Something as minor as your doctor not using the VA’s specific verbiage and language can result in a denial.
  • The VA says that you were never diagnosed with a condition. In order to get your claim granted, you need to have been diagnosed with an injury or illness. For example, while exposure to dangerous substances may lead to a valid disability claim, the exposure itself will not get you benefits without a proper diagnosis of the disability from your doctor. This is especially important for mental health illnesses such as PTSD. Even if you are being treated for symptoms, you must have your doctor officially diagnose you if you seek veterans benefits.

Attorney Susan E. Criss spent 15 years serving as a Texas District Judge. She is Board Certified in Criminal Law by the Texas Board of Legal Specialization. She is also a former prosecutor who served almost a decade in the Galveston County Criminal District Attorney’s Office.
